Terms and Conditions

TERMS AND CONDITIONS

 

1)      Services Offered:

JobbTree Consultancy Services will only be liable for digital/physical presence of the candidates. JobbTree will take all the necessary steps & ensure candidates reach to the employer’s location or is present digitally for interview.

2)      Payment Terms:

  1. Any dispute, not raised within 7 days of expiry of service delivery validity, shall be deemed fit to be payable and client shall be liable to pay as per the raised invoice.
  2. Any dispute in the invoice is to be intimated for correction, with concerned SPOC of JobbTree Consultancy Services, within 7 working days of receipt of invoice.
  3. If the Client fails to make the requisite payments within time, then the Client shall also be liable to interest @ 2%p.m. This right shall be in addition to all other rights which JobbTree Consultancy Services may have.

3)      Refund Policy:

The client shall be entitled for refund of amount paid for services as mentioned below:

As per the conditions defined here-in, refund request can be raised in case there is a breach of the deliver terms & conditions as per Order Confirmation under the following scenarios:

Scenario 1: JobbTree Consultancy Services is unable to provide any service as agreed upon per the agreement and as per specified timelines.                                                                                                                                                                                    Refund Amount – 100%

Scenario 2: Partial fulfilment by JobbTree Consultancy Services on the services agreed upon as mentioned in Order Confirmation (Agreement) within the agreed timelines.                                                                                                                                      Refund Amount – On pro-rata basis

Amount Forfeiture: JobbTree Consultancy Services holds the right to forfeit the amount paid in case the client is not able to provide the following within the stipulated timeline:

  1. Client is not able to intimate JobbTree Consultancy Services within 7 days of expiry of delivery period regarding non-fulfilment of Order Confirmation/ Agreement condition.
  2. Change in job profile as per the criteria shared and agreed at the time of signing the agreement. If any change, the same needs to be communicated at least 2 weeks before the Job seeker/ Candidate is lined-up for interview.
  3. Details of profiles shortlisted/turned up for interview or any other service delivery related input/feedback not been shared with JobbTree Consultancy Services within the stipulated time frame as agreed in the agreement.
  4. Reasons of rejection for each candidate not being shared with JobbTree Consultancy Services.
  5. Any candidate, here defined as Job seeker, who has been hired directly by the employer thereafter (within 60 days of rejection) who went through interview through JobbTree Consultancy Services, shall be billed to the client.

Conditions:

  1. Refund request, once initiated (post due diligence & relevant approvals by JobbTree Consultancy Services), would take min. 14 working days to get processed and paid.
  2. Mode – Through NEFT/RTGS/Cheque payable in the name of source/client where from the payment has been received by JobbTree Consultancy Services and only upon a formal request by the valid authority from the client end. No transfer of payment/s to any other name to be entertained.  
  3. Amount - The refund would be for the total amount realized (as per work order/Order Confirmation) less tax & other service charges as applicable.
  4. Refund request would only be entertained in case if there is partial or no service fulfilment within the subscription period towards the client’s requirement.

Note: In no other conditions shall the Client be entitled to any refunds.

4)      Prohibited Uses of JobbTree Consultancy Services Site:

Users warrant to only utilise the Sites in accordance with these Terms of Use and any relevant statutory provisions. Users are prohibited from violating the security of any Site by engaging in the following: (a) accessing data not intended for such user or logging into an account which the user is not authorized to access; (b) attempting to test the vulnerability of a system or to breach any security or authentication measures; or (c) attempting to overload, spam, or crash any Site by means of a “virus” or other software “attack” upon the Sites’ integrity. Any attempted Site violations may result in civil or criminal liability, and JobbTree Consultancy Services will prosecute users who are involved in such violations.

Users may not use any Sites in order to transmit, or store material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, (c) that is defamatory, obscene, threatening, abusive or hateful, or (d) in a manner which jeopardizes India’s national security,  contributes to social unrest, or sectarian violence.

All users agree not to engage in any activity which seeks to take advantage of or exploit other users of the Site, or of the Site itself. This prohibited behaviour includes, but is not limited to, the following: (a) deleting any content; (b) engaging in any behaviour which has the effect of degrading the performance of the Site; (c) reverse engineering any portion of the Sites; (d) using or inserting a personal or corporate URL, web link, or email address, into any portion of the Site (except where specifically requested by the Site) and (e) duplicating,  posting, or linking any Site content to other sites not belonging to JobbTree Consultancy Services.

5)      JobbTree Consultancy Services Liability:

JobbTree Consultancy Services Sites provide a job portal, intended to act as a market place for “job seekers” and “job providers”. JobbTree Consultancy Services has no control over the quality or legality of the jobs, or job seeker qualifications. JobbTree Consultancy Services makes no representations about the truthfulness of any jobs posted, job seeker information or user content on the Sites, and encourages all employers to conduct their own investigation as to a job seeker’s suitability for employment and trustworthiness.

JobbTree Consultancy Services site may contain inaccuracies or typographical errors. JobbTree Consultancy Services makes no representations about the accuracy, or completeness of any Site or any content. JobbTree Consultancy Services is not to be considered an employer and shall not be responsible for any employment decisions. JobbTree Consultancy Services cannot guarantee that any job seeker will be exactly what any employer wants, or that the job seeker will perform as required.  No advice or information obtained by a user from the Sites shall create any warranty whatsoever.

User authentication on the Internet is impossible and therefore JobbTree Consultancy Services does not warrant that each user is who they claim to be. Since JobbTree Consultancy Services is not, and cannot be involved in user-to-user dealings or control the behaviour of the participants on any Site, in the event that you have a dispute with one or more users, you release JobbTree Consultancy Services (and our agents and employees) from claims and damages (whether actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Please note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people who misrepresent themselves. When you use the services provided by JobbTree Consultancy Services you assume all risks associated with dealing with other users with whom you come in contact. By its very nature, other people’s information may be offensive, harmful, inaccurate, or untrue.

You also represent and warrant to JobbTree Consultancy Services that you will use the site in a manner consistent with any and all applicable laws and regulations. JobbTree Consultancy Services in no way either represents or guarantees the accuracy, reliability or the truthfulness of any User content.

In addition to the same, JobbTree Consultancy Services does not guarantee or in any other way represent/warrant the genuineness of any of the Candidates/job seekers and it shall be the sole responsibility of the Client to verify in all respect to verify the credentials/genuineness/suitability of the job seeker in all respect whatsoever (including background verification).

6)      Permitted Uses of Our Sites:

All content is the property of JobbTree Consultancy Services, and all content is protected by applicable trademark laws, both Indian and foreign. You are not allowed to sell or modify the site’s content for any public or commercial use. In case of any violation, JobbTree Consultancy Services shall have the right to take any action permitted under law. The use of the site’s content on any other web site or in a networked computer environment for any purpose is also expressly prohibited.

7)      Prohibited Content on Our Site-How to Report Abuse:

Any content which is offensive, dangerous, invades the privacy of others, or is unlawful is prohibited from the Sites: This includes, but is not limited to, the following: (a) pornography,; (b) solicitation of illegal activities; (c) racial, religious, or ethnic slurs (d) incitement to violence against any individual for whatever reason; (e)  the sending of junk mail or spam; (f) violating or advocating the violation of copyrighted works; (g) releasing private information of another user without their consent; and (g) providing information or instruction about illegal activities.

8)      Collection and use of information by JobbTree Consultancy Services:

In some areas of Registration & Profile creation, JobbTree Consultancy Services request or may request that you provide personal information, including your name, address, e-mail address, telephone number, credit card number, contact information, billing information and any other information from which your identity is discernible. In other areas, JobbTree Consultancy Services collect or may collect demographic information that is not unique to you such as your code, age, preferences, gender, interests and favourites. Sometimes JobbTree Consultancy Services collect or may collect a combination of the two types of information.

JobbTree Consultancy Services also gather or may gather certain information about your use of Site, such as what areas you visit and what services you access. Moreover, there is information about your computer hardware and software that is or may be collected by JobbTree Consultancy Services. This information can include without limitation your IP address, browser type, domain names, access times and referring Web site addresses, but is not linked to your personal information.

In addition, at the time of registration, you have the option to elect or not elect to receive additional communications, information and promotions, including without limitation, free informational newsletters from us relating to topics that may be of special interest to you, such as career management advice.

JobbTree Consultancy Services have areas on the Site where you can submit feedback. Any feedback you submit in these areas becomes our property, and JobbTree Consultancy Services can use such feedback (such as success stories) for marketing purposes or to contact you for further information.

9)      Choices regarding the disclosure of personal information to others:

JobbTree Consultancy Services may disclose information to third parties if you consent to such disclosure. JobbTree Consultancy Services may use data about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third-party.

JobbTree Consultancy Services may disclose information if legally required to do so, if requested to do so by a governmental entity or if JobbTree Consultancy Services believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.

JobbTree Consultancy Services discloses and transfer information to a third party who acquires all or a substantial portion of our business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event JobbTree Consultancy Services become the subject of a bankruptcy proceeding, whether voluntary or involuntary, JobbTree Consultancy Services or our trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by the bankruptcy court. You will be notified of sale of all or a substantial portion of our business to a third party via email or through a prominent notice posted on the website.

10)   If you send unsolicited ideas JobbTree Consultancy Services has the right to use them without compensation:

You are always welcome to provide JobbTree Consultancy Services with your opinion as to the quality of service provided by JobbTree Consultancy Services, however, please do not send us any creative ideas, suggestions or other materials. If you do provide JobbTree Consultancy Services with such materials, please be advised that all such ideas will become the property of JobbTree Consultancy Services, and JobbTree Consultancy Services will incur no obligation to you, and can use all such ideas without compensation.

11)   What To Do If You Suspect Copyright Infringement:

If you believe that your copyrighted work is on our site in an infringing manner please provide JobbTree Consultancy Services with the following:

  1. Identify the material on the Site that you claim is infringing, with enough detail so that JobbTree Consultancy Services may locate it.
  2. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  3. A statement by you declaring under penalty of perjury that (1) the above information in your Notice is accurate, and (2) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner;
  4. Your address, telephone number, and email address; and your physical or electronic signature.

JobbTree Consultancy Services will remove the infringing posting(s), subject to the procedures outlined in the Digital Millennium Copyright Act (DMCA). If you have a copyright related inquiry, please contact: care@jobbtree.com

12)   You acknowledge and warrant that JobbTree Consultancy Services has not instigated and/ or forced you to deposit money in JobbTree Consultancy Services account in return of job guarantee or assured placement.

13)   Limitations of Liability:

In no event shall JobbTree Consultancy Services, affiliates, or its supplier’s suppliers, or any third parties mentioned on any of JobbTree Consultancy Services site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use any of JobbTree Consultancy Services site and content, whether based on warranty, contract, tort, or any other legal theory, and whether or not JobbTree Consultancy Services is advised of the possibility of such damages. The content appearing on JobbTree Consultancy Services website could include technical, typographical, or photographic errors. The content includes but is not limited to a) Job Postings. JobbTree Consultancy Services does not warrant that any of the content on its website is accurate, complete, or current.

14)   General:

Be sure to refer to the Terms and Conditions regularly, since they change, and they do govern your relationship to JobbTree Consultancy Services. The Terms and Conditions constitute the entire agreement between you and JobbTree Consultancy Services and govern your use of the Service. The Terms and Conditions and the relationship between you and JobbTree Consultancy Services shall be governed by the laws of the country of India without regard to its conflict of law provisions. The failure of JobbTree Consultancy Services to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.

15)   Governing Law & Jurisdiction:

The Terms and Conditions shall be governed by law of Indian. Any disputes/differences (by whatever name called) in connection with any action or proceeding (by whatever name called) arising out of this Agreement shall be governed by the laws of the State of Tamil Nadu without regard to its conflict of law provisions.
